Terms and Conditions for Use of Seamless Designs from Google Drive
By accessing, downloading, or using any seamless designs (the "Designs") from the provided Google Drive folder, you ("User") agree to the following Terms and Conditions:
1. Access to the Google Drive

Access to the Google Drive folder is provided solely for the purpose of personal or commercial use under the conditions set out in these Terms.

You are responsible for ensuring that you have the correct permissions and software to download and use the Designs.
2. License and Usage Rights

You are granted a limited, non-exclusive, non-transferable, and revocable license to use the seamless Designs as outlined below:

Personal and commercial design projects are allowed, but the Designs must be used as part of a larger creative work.

The Designs may not be used as standalone designs. You must combine the Designs with other elements to create an original piece.

For fabric printing, a separate license is required for any fabric that will be printed outside of the USA. Printing within the USA does not require an additional license.
3. Permitted Uses
You may use the Designs in:

Personal projects (e.g., DIY crafts, home decor) and commercial products (e.g., tumblers, apparel, and other items), as long as the Designs are part of a larger design and not the sole or primary visual element.

Printed fabric with the proper licensing for any fabric printed outside the USA.

Incorporation into larger design projects (e.g., websites, branding, packaging) where additional creative elements are added to form a new and unique design.
4. Restrictions on Use
You may not:

Copy, share, redistribute, or resell the Designs, whether modified or unmodified, in any format (digital or physical).

Trace, alter, or distort the Designs in a way that significantly changes the original art.

Give away or distribute the Designs in any freebie groups, dump groups, or any file-sharing services.

Use the Designs as standalone items or create derivative works that do not incorporate other design elements. The Designs cannot be the primary design for any item or project without additional creative input.

Upload the Designs to any platforms that allow sharing or selling digital assets (e.g., stock photo websites, digital marketplaces).

5. Fabric Printing License

For fabric printed within the USA, no additional license is required.

For fabric printed outside the USA, a separate commercial license must be purchased prior to printing. The User is responsible for ensuring compliance with this requirement.
6. Ownership and Intellectual Property

The seamless Designs remain the intellectual property of DSSC. You may not claim ownership of the Designs or any derivative work that consists mainly of the original Designs.

The creator retains all rights to the Designs, including copyright and the right to distribute, license, or revoke access to the Designs at any time.
7. Prohibited Activities
You are prohibited from:

Copying, sharing, or redistributing the Designs in any form.

Using the Designs in any manner that violates the creator's intellectual property rights.

Creating products or services that compete with the Designs or involve reselling the original files as part of another digital or physical product collection.

8. Colors and Printing Disclaimer
Due to variations in printers, inks, and monitor settings, colors of the printed Designs may differ from what is seen on-screen. DSSC is not responsible for any color discrepancies that occur in printed products.
9. Termination of License

This license may be terminated if any Terms outlined here are violated.

Upon termination, you must immediately cease all use of the Designs and remove any products or designs that incorporate the Designs from public distribution or sale.
10. No Warranty
The Designs are provided "as-is" without any warranty, express or implied. DSSC is not responsible for any damages, losses, or legal issues that arise from the use of the Designs.
11. Amendments and Modifications
DSSC reserves the right to update or amend these Terms and Conditions at any time. It is your responsibility to review these Terms before using the Designs to ensure compliance.

The following activities are strictly prohibited:

Tracing, altering, or modifying the files in a way that significantly distorts or reproduces the original artwork.

Giving away the files as freebies, including sharing in dump groups or other platforms that allow free download of design assets.

Using the Artwork as a standalone design without incorporating other creative elements to form an original piece.

Reselling or licensing the original seamless PNG files in any form, including as part of other clipart or design bundles.
4. Fabric Printing License

For fabric printed within the USA, no additional license is required.

For fabric printing outside the USA, a separate license must be purchased. You must obtain this license before printing on any fabric intended for commercial or personal use outside the USA.
5. Ownership and Intellectual Property

However, the number of items made and sold using our designs is limited to a total of 500 units per design. If you wish to exceed this limit, please contact us for an extended license.

2. Intellectual Property
All designs and digital files are the intellectual property of Dark Side Star Creations (DSSC) Purchase of a file does not transfer ownership of the design to you. You are purchasing a license to use the design under the above terms.
3. Returns and Refunds
Due to the nature of digital products, all sales are final. We do not offer refunds, exchanges, or cancellations once the files have been downloaded. If you encounter any issues with your purchase or file, please contact us within 7 days of purchase, and we will do our best to assist you.
4. File Delivery
Digital files will be delivered automatically after payment is processed. You will receive a download link via email or directly through your account on our website. Please ensure you have access to the appropriate software to use these files (e.g., Procreate Adobe Illustrator, Photoshop, etc.).
5. File Formats
Unless stated otherwise, designs are provided in PNGS. It is your responsibility to ensure your equipment and software are compatible with these file formats before purchasing.
6. Liability
Darkside Star Creations (DSSC) is not liable for any damage or issues arising from the use or misuse of our designs. It is your responsibility to ensure that the end product complies with any applicable copyright laws, trademarks, or licensing agreements.
